New Jersey has thrown a major curveball into the national conversation on discrimination law. The state’s Division on Civil Rights has rolled out sweeping new rules that not only reaffirm disparate impact liability under state law, but also introduce tougher, broader standards affecting lending, housing, employment and more. This approach is in direct tension with the federal government’s view of disparate impact theory — including President Donald Trump’s executive order on “Restoring Equality of Opportunity and Meritocracy” and proposed revisions to Regulation B under the Equal Credit Opportunity Act. The result is a widening divide: States and federal regulators are increasingly embracing conflicting visions of what compliance with antidiscrimination laws means.
