Earlier this summer, the U.S. Supreme Court issued a major ruling overturning the Chevron doctrine, affording federal agencies less room to interpret the laws they administer and directing courts to rely on their own interpretations of ambiguous laws. The Chevron doctrine, established in 1984, directed courts to defer to an agency’s reasonable interpretation of an ambiguous statute that it administers. The doctrine had long been a cornerstone of modern administrative law. The decision to overturn the Chevron doctrine signals a fundamental shift in courts’ oversight of federal agencies. Will this new interpretative methodology level the playing field or will it create more discrepancies? What will the impact be on the regulatory outlook moving forward and is increased litigation inevitable?
